In certain circumstances, violations may be referred to the MLS Rules Enforcement Committee for a formal hearing instead of being resolved through the standard automatic fine process.
Rule 1102 outlines the situations in which MLS staff may escalate a matter for committee review due to repeat offenses or failure to correct time-sensitive violations.
1102.1 – Excessive Repeat Violations
If a Participant—including all Subscribers affiliated with that Participant—incurs five (5) or more violations of the same Rule within a twelve (12) month period, and that Rule carries an automatic fine:
MLS staff may refer the current violation to the MLS Rules and Procedures Committee for a hearing.
This referral may occur in lieu of issuing the scheduled automatic fine.
This provision applies to repeat violations at the office level and is intended to address patterns of non-compliance.
1102.2 – Failure to Timely Correct Time-Sensitive Violations
Certain violations are designated as time-sensitive and subject to escalating fines if not corrected promptly.
If a time-sensitive violation remains uncorrected for five (5) days or more:
MLS staff may refer the matter to the MLS Rules and Procedures Committee for a hearing.
This referral may occur instead of assessing the fully escalated fine.
This provision ensures that ongoing non-compliance may be addressed through formal review rather than continued monetary escalation.
