Office Exclusive listings must be submitted to the MLS before midnight of the day after their Listing Date and must include a duly signed Office Exclusive Seller Disclosure. A Participant may take an Exclusive Right to Sell or Exclusive Agency listing as an Office Exclusive only after informing the owner of the benefits of MLS and obtaining the owner’s signed acknowledgment. The Office Exclusive and the owner’s acknowledgment must be submitted to the MLS pursuant to Rule 303.2. Office Exclusives remain on file with the MLS as confidential material and are not disclosed to third parties.
Steps to Correct This Violation:
- Confirm that the listing is designated as an Office Exclusive and that the seller signed the Office Exclusive Seller Disclosure acknowledging the benefits of the MLS.
- Enter the listing into the MLS as a private listing. Upload your Office Exclusive Seller Disclosure under Documents (Private).
- For late or missing documentation, email a copy of the signed Office Exclusive Seller Disclosure to compliance@onekeymls.com.
- Retain written documentation of the seller’s acknowledgment for your records.
