OneKey® MLS has updated our Rules and Procedures in alignment with the NAR settlement in the Sitzer-Burnett case, which aims to shield the MLS and its customers from future liability related to this lawsuit. Adapting to these new rules and procedures is necessary to comply with the terms and receive the protections of the settlement. These changes, effective today, August 8, include:
A prohibition against mention of compensation in OneKey® MLS. To support that change:
- Compensation fields will be removed today from the MLS.
- Listings that contain mention of compensation as of today will be subject to removal of that information and compliance notices. Agents with listings that mention compensation in free-form fields such as remarks have been notified to manually remove that verbiage ahead of today’s deadline.
- New agreements or addendums are needed for existing listings to replace outdated forms that include mention of compensation. Remember that listing agreements are retained by your office but must be submitted to the MLS upon request within 24 hours.
