Earlier this week the National Association of REALTORS® (NAR) unveiled a new policy called “Multiple Listing Options for Sellers.” The new policy is the result of extensive examination of policy and practice across the organization. It is designed to give consumers clearer freedom in marketing their homes while ensuring fairness to buyers.
Multiple Listing Options for Sellers includes a new status of listings, “delayed marketing exempt listing”. This option allows sellers to postpone public marketing of their listing while making the property visible to real estate professionals within the MLS. During the delayed marketing period, the home seller and the listing agent can market the listing in a manner consistent with the seller’s needs and interests. For example, a delayed marketing listing may be entered with syndication sending it to virtual office websites (VOWs) based on the seller’s instructions. The time allowable for properties to utilize delayed marketing exempt will be determined by the OneKey® MLS Board of Managers.
Broker-to-broker, one-to-one communication may occur freely about delayed marketing exempt listings or office exclusive listings without triggering Clear Cooperation Policy (CCP) requirements to make the listing public (marking it Private: N in the MLS) and Active within one (1) business day. Multi-brokerage communications regarding exempt or office exclusive (Private) listings do trigger Clear Cooperation Policy (CCP) and are considered public marketing.
Here's what you need to know now:
- This new option operates alongside CCP and does not change mandatory submission policies.
- A signed seller disclosure documenting informed consent to waive the benefits of immediate public marketing through IDX and syndication will be required for transparency and informed consent.
- The timeline for delayed marketing listings will be tailored to local needs and OneKey® MLS Board of Managers will determine the time that a listing may remain in that status.
- Implementation of these new policies for the OneKey® MLS community will be by September 30, 2025, or sooner.
