What are the Multiple Listing Options for Sellers?
The Multiple Listing Options for Sellers introduces a new status of exempt listing: delayed marketing in addition to the existing office exclusive exempt listing. Definitions for these are below:
Office Exclusive - An exempt listing where the seller has directed that their property not be disseminated through the MLS and not be publicly marketed. The listing is visible only to members of the listing brokerage. It does not disseminate to other sites.
Delayed Marketing - An exempt listing where the seller has directed that their property not be disseminated through IDX and other syndication for a period of time. The maximum time period allowable will be determined by OneKey MLS Board of Managers and will be announced at a later date. The listing is visible within the MLS to all Brokers and Participants. During the delayed marketing time period the home seller and listing agent can market the property through VOW sites, if desired.
Why was the Multiple Listing Options for Sellers policy implemented?
The policy was created after examination of CCP by NAR across the industry. It's designed to promote transparency and individual choice while promoting a fair and equitable marketplace.
When was Multiple Listing Options for Sellers announced and when will it go into effect for OneKey MLS Participants and Subscribers?
The new Multiple Listing Options for Sellers policy was announced March 25, 2025 and though the date of implementation for the OneKey MLS community has not been determined it will be by September 25, 2025, if not sooner.
Will I be able to share or show a delayed marketing exempt listing to potential buyers?
Yes, you may share a delayed marketing exempt listing to potential buyers and arrange showings and tours subject to the seller's instructions.
Is there a disclosure form required for delayed marketing exempt listings and where can I find it?
Yes, a seller's disclosure form is required for exempt listings. Determinations regarding forms are currently in-progress and will be announced prior to implementation of the policy.
How do I opt-in or out of syndication?
Within Add/Edit you may utilize the Distribution section Syndicate To field to indicate how your listing will be syndicated. By default, indicating Y in Private Listing (Office Exclusive) will ensure that your listing will only be visible with the MLS system to agents within the same firm and will not syndicate.
Will I be able to convert an office exclusive exempt listing to a delayed marketing exempt listing?
Yes, the seller can instruct the agent to change their marketing strategy from office exclusive to delayed marketing exempt. Signed written certification of that decision will be required for that change.
